Terms and Conditions

Welcome to Airpinner. These Terms and Conditions ("Terms") govern your use of the Airpinner website, application, and services (collectively, the "Service") operated by Airpinner (ABN 49 725 755 315) ("we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
1. Eligibility
You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into these Terms.
If you access the Service from outside Australia, you represent and warrant that you meet the minimum age and legal capacity requirements applicable in your country of residence. Where required by local law, use of the Service by minors is subject to valid parental or guardian consent.
2. Description of Service
Airpinner is a software-as-a-service (SaaS) platform that enables users to:
- Upload and process aerial/drone photographs
- Automatically detect and label Points of Interest (POIs)
- Customise label styles and export professional images
The Service processes images in your browser. We do not store your original photographs on our servers.
While the Service primarily processes images client-side and does not store full-resolution original photographs on our servers, limited temporary technical processing, caching, or logging may occur solely for the purpose of operating, securing, and improving the Service.
The Service is not intended for use in aviation navigation, safety-critical systems, emergency response, or any decision-making where inaccurate data could result in personal injury, property damage, or legal liability.
3. Account Registration
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised access
We reserve the right to suspend or terminate accounts that violate these Terms.
We reserve the right to suspend or terminate accounts that violate applicable export control laws, economic sanctions, or cross-border regulatory requirements.
You are responsible for ensuring that your account information remains accurate, current, and compliant with applicable tax and regulatory requirements in your jurisdiction.
4. Credits and Subscriptions
4.1 Free Trial
New users receive 20 free credits upon registration. These credits provide full access to all Service features.
4.2 Subscriptions
After using your free credits, continued use requires a paid subscription. Subscription plans and pricing are displayed on our website and may be updated from time to time.
We reserve the right to modify subscription plans, credit limits, features, or pricing structures for technical, regulatory, security, or commercial reasons, provided such changes do not affect accrued statutory consumer rights.
4.3 Credit Usage
- Credits are consumed when using certain features (e.g., POI searches, image exports)
- Credit costs for each action are displayed before use
- Unused credits remain valid for your subscription period plus one (1) additional month (rollover period)
- Credits that are not used within the rollover period will expire
Unless otherwise stated, subscription credits are consumed before any purchased top-up credits, except where top-up credits are approaching expiry.
4.4 Billing
- Subscriptions are billed in advance on a recurring basis (monthly or annually)
- You authorise us to charge your chosen payment method
- Prices are in Australian Dollars (AUD) unless otherwise stated
Subscription fees and credit prices may not include value added tax (VAT), goods and services tax (GST), or other similar taxes imposed outside Australia. You are responsible for any applicable local taxes or duties.
4.5 Annual Subscriptions
Annual subscriptions are billed upfront for the full year at a discounted rate (approximately 15% savings compared to monthly billing).
- Credits are delivered monthly (e.g., 50 credits/month for Starter Annual)
- Unused credits roll over for one (1) additional month only
- Annual subscriptions are non-refundable after purchase
- Upon cancellation, you retain access to the Service and continue receiving monthly credits until the end of your annual billing period
4.6 Top-up Credit Packs
In addition to subscription credits, you may purchase one-time top-up credit packs at any time, with or without an active subscription.
- Top-up credits are valid for six (6) months from the date of purchase
- Top-up credits are used after your subscription credits are exhausted, unless the top-up credits are expiring within 7 days
- Expired top-up credits cannot be recovered or refunded
- Top-up purchases are non-refundable
5. Cancellation and Refunds
5.1 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. If you subscribed through a third-party platform such as the Apple App Store or Google Play Store, subscription management, cancellation, and refunds may also be handled through that platform in accordance with its terms.
5.2 No Refunds
Except as required by the Australian Consumer Law, all payments are non-refundable.
This includes:
- Subscription fees already paid (monthly or annual)
- Unused credits at time of cancellation
- Downgrades to lower-tier plans
- Top-up credit pack purchases
Upon cancellation of a monthly subscription, you retain access to your remaining credits for the rollover period (one month after your subscription ends).
Upon cancellation of an annual subscription, you retain full access to the Service and continue receiving monthly credits until the end of your paid annual period.
Nothing in this section limits or excludes any mandatory consumer rights or statutory guarantees that may apply to you under laws outside Australia.
5.3 Plan Changes
You may upgrade or downgrade your subscription plan at any time. Changes take effect on your next billing cycle. No refunds or credits are provided for plan changes.
5.4 Cooling-Off Period
For your first payment only, you have 48 hours to request a full refund if you are not satisfied with the Service, no questions asked. To request a refund, contact us at hello@airpinner.com within 48 hours of your first payment.
This cooling-off period applies only to your initial subscription payment and does not apply to subsequent renewals or additional credit purchases.
This cooling-off period is provided in addition to any rights you may have under the Australian Consumer Law.
Any cooling-off or refund period described in these Terms does not limit additional withdrawal or refund rights that may apply under mandatory consumer protection laws in certain jurisdictions, including the European Union.
6. Acceptable Use
You agree NOT to use the Service to:
- Upload content that infringes intellectual property rights
- Process images containing illegal content
- Attempt to reverse engineer, hack, or compromise the Service
- Use automated systems to access the Service without permission
- Resell or redistribute the Service without authorisation
- Violate any applicable laws or regulations
You must not use the Service in a manner that violates applicable privacy, data protection, surveillance, or image-processing laws, including but not limited to GDPR, CCPA, or similar regulations.
We may suspend or restrict access to the Service without prior notice where we reasonably believe such action is necessary to prevent legal, security, or regulatory risk.
7. Intellectual Property
7.1 Our Property
The Service, including its design, features, code, and branding, is owned by Airpinner and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
7.2 Your Content
You retain full ownership of all photographs and images you upload to the Service. By using the Service, you grant us a limited, non-exclusive licence to process your images solely for the purpose of providing the Service.
We do not claim any ownership rights over your images or exported content.
You represent and warrant that you own or have all necessary rights, licences, and permissions to upload and process any images or content submitted to the Service.
You agree to indemnify and hold harmless Airpinner from any claims, damages, or liabilities arising out of third-party intellectual property rights in relation to content you upload.
7.3 Exported Images
All images exported from the Service belong entirely to you. You are free to use them for any personal or commercial purpose.
8. Disclaimers and Limitations
8.1 Service Accuracy
The Service uses third-party data sources (including Google Places API) to identify and label Points of Interest.
We do not guarantee the accuracy, completeness, or reliability of POI information.
You acknowledge that:
- POI locations may be inaccurate or outdated
- Labels may not perfectly align with actual locations
- Some POIs may be missing or incorrectly identified
You are responsible for verifying the accuracy of all labels before using exported images professionally.
8.2 No Warranty
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
8.3 Limitation of Liability
To the maximum extent permitted by law, Airpinner shall not be liable for any indirect, incidental, special, or consequential damages, loss of profits, data, or business opportunities, damages arising from your use or inability to use the Service, or errors or inaccuracies in POI data or label positioning.
Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
8.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) which cannot be excluded, restricted, or modified by agreement.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, warranties, or rights that cannot be excluded under the Australian Consumer Law or equivalent mandatory laws in other jurisdictions.
9. Third-Party Services
The Service integrates with third-party services including:
- Google Places API (for POI data)
- Supabase (for data storage and authentication)
- Stripe (for payment processing)
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
We are not responsible for changes to, interruptions of, or discontinuation of any third-party services, APIs, or integrations, including pricing or availability changes imposed by such providers.
10. Privacy
Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your information.
11. Modifications to Service and Terms
11.1 Service Changes
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.
11.2 Terms Changes
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on our website, updating the "Last updated" date, and sending an email notification for material changes.
We may make changes to the Service or these Terms where required for legal compliance, security, fraud prevention, or technical reasons.
Your continued use of the Service after changes constitutes acceptance of the updated Terms.
Your continued use of the Service following any changes constitutes acceptance of the updated Terms only to the extent permitted by applicable law.
12. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, fail to pay subscription fees, or use the Service in a manner that may harm us or other users.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
13. Governing Law and Disputes
13.1 Governing Law
These Terms are governed by the laws of Queensland, Australia, subject to any mandatory consumer protection laws that apply in your country of residence.
If you are a consumer residing outside Australia, you may also benefit from mandatory consumer protection laws in your country of residence, and nothing in this clause prevents you from bringing claims in a competent local court where required by law.
13.2 Dispute Resolution
Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at hello@airpinner.com.
14. General Provisions
14.1 Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or telecommunications failures, third-party API outages, or cloud service provider issues.
14.2 No Professional Advice
The Service is a tool for labelling aerial photographs and does not constitute professional advice of any kind. For real estate, surveying, legal, or other professional matters, please consult appropriately qualified professionals.
14.3 Export Compliance
You must comply with all applicable export control, trade sanctions, and embargo laws in connection with your use of the Service.
14.4 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Airpinner. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. You may not assign your rights under these Terms without our consent.
